Terms of Service
These Terms of Service ("Terms") are a binding agreement between you and Tomeapps, Romania ("we", "us") governing your use of the Girlfriend Simulator mobile application (the "App"). By creating an account or using the App you accept these Terms and our Privacy Policy. If you do not agree, do not use the App.
1. What the App is — and is not
The App is an interactive entertainment product. AI-generated content can be inaccurate, inconsistent or unexpected. You are solely responsible for how you interpret and act on it.
2. Eligibility — 18+
You must be at least 18 years old to use the App. By using it you represent that you are 18 or older. We may suspend or terminate accounts we reasonably believe belong to minors.
3. Not a crisis, medical or therapy service
The App is not a substitute for professional mental-health care and its characters cannot help you in an emergency. If you are in danger or thinking about harming yourself, stop using the App and contact your local emergency number (112 in the EU) or a suicide-prevention line (in Romania: 0800 801 200). While the App attempts to respond supportively and point to real help when concerning content is detected, this is a best-effort software feature and no substitute for professional help — we make no guarantee it will detect or respond appropriately to any particular situation.
4. Your account
- A guest account is created automatically; you may link an email address to keep your progress.
- You are responsible for the security of your credentials and for all activity on your account.
- You may delete your account at any time in the App (Me → Delete account). Deletion becomes permanent after a 30-day grace period (see the Privacy Policy).
5. Acceptable use
You agree NOT to:
- use the App if you are under 18, or make it available to anyone under 18;
- submit content that is illegal, or that sexualises minors in any way (zero tolerance — instant termination and, where required, reporting to authorities);
- attempt to jailbreak, prompt-inject or otherwise manipulate the AI into producing content that violates these Terms;
- reverse-engineer, scrape, resell, or access the service by automated means;
- abuse, defraud or exploit the service, its billing, or its usage limits;
- use the App to harass any real person or to generate content about real persons.
We may moderate content automatically, restrict features, and suspend or terminate accounts that violate these Terms, with or without notice.
6. Subscriptions, purchases & usage limits
- Parts of the App are free with usage limits; paid subscriptions unlock higher limits and additional features. Prices are shown in-app before purchase.
- Payments are processed by Apple App Store / Google Play under their terms. Subscriptions renew automatically until cancelled in your store account settings. Refunds are handled exclusively by the app stores under their policies.
- Usage limits (message and photo allowances, feature caps) are part of the product design and may be adjusted over time.
- Virtual content (conversations, progress, unlocks, "relationship" states) has no monetary value, is not redeemable, and may be modified or reset as part of product changes.
7. Intellectual property
The App, its characters, artwork, generated images, software and branding are owned by us or our licensors. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for private entertainment. You may not use App content commercially without our written permission. You retain rights to the text you write; you grant us a licence to process it as needed to operate the service (see the Privacy Policy).
8. Service changes & availability
We may modify, suspend or discontinue any part of the App (including characters, features, AI providers and content libraries) at any time. We aim for high availability but the service is provided without uptime guarantees.
9. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT AI-GENERATED CONTENT WILL BE ACCURATE, APPROPRIATE, OR MEET YOUR EXPECTATIONS, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, USE OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP — INCLUDING ANY RELIANCE ON AI-GENERATED CONTENT OR ANY EMOTIONAL DISTRESS ARISING FROM FICTIONAL INTERACTIONS; AND (b) OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR €50 IF YOU PAID NOTHING. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED BY LAW (INCLUDING FOR INTENT OR GROSS NEGLIGENCE).
11. Indemnification
You will indemnify and hold us harmless from claims, damages and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the App.
12. Termination
You may stop using the App and delete your account at any time. We may suspend or terminate your access for breach of these Terms, suspected fraud or abuse, or where required by law. Sections 7, 9, 10, 11 and 14 survive termination.
13. Changes to these Terms
We may update these Terms; material changes will be announced in the App. The Effective date above reflects the current version. Continued use after changes take effect constitutes acceptance.
14. Governing law & disputes
These Terms are governed by the laws of Romania. Disputes are subject to the competent courts of Romania, without prejudice to mandatory consumer protections and jurisdiction rules of your country of residence (for EU consumers). EU users may also use the European Commission's Online Dispute Resolution platform.
